summary judgment for a gynecologist

Abbreviated judgment for a gynecologist accused of causing the death of a baby girl in the womb on Christmas day last year. The lawyer of the doctor Miriam Lo Porto, 38 years old, the lawyer Aldo D’Amico, formalized the procedural strategy at the pre-trial hearing before judge Rossella Ferraro.

The doctor, in particular, according to what emerges from a consultation ordered by the prosecutor’s office, omitted the diagnosis of growth retardation of the fetus despite it being the result of an ultrasound carried out 19 days before the termination of the pregnancy.

According to the accusation, the failure to indicate the diagnosis on the medical record of the patient that the specialist was treating would have eliminated an element of knowledge necessary for subsequent visits. Furthermore, urine tests and high blood pressure would have been very indicative of growth retardation.

The circumstance, according to what the prosecutor Giovanni Di Leo hypothesizes who ordered the gynecologist to be summoned to trial, would have caused the death of the fetus: an early birth, however, would have allowed the tragedy to be avoided.

The patient’s hospitalization, according to what the prosecutor’s office hypothesizes, could have in fact allowed the birth: on December 27, however, the thirty-year-old woman gave birth to her baby who had already been dead for at least 48 hours.

The little girl’s parents filed a civil action with the assistance of the lawyers Giacinto Paci and Diego Giarratana, whose complaints launched the investigation which, initially, involved 13 suspects. The hearing was adjourned to May 20.
