Unsuitable technical manager, what are the consequences?

Dictate the methods and timing of notification of cancellation provisions starting from 16 April 2024 and by 30 April 2024

What is it about?

With Circular no. 1 of 15 April 2024, the Committee dictates that in order to make the behavior of the regional and provincial Sections uniform across the entire national territory, considering what is established with circular no. 3 of 10 October 2023 and resolution no. 5 of 11 October 2023, regarding the timing and methods of initiating disciplinary proceedings aimed at cancellation, the National Committee deemed it useful to establish a common procedure that the Sections are required to observe.

Once the deadline of 15 April 2024 provided for by article 1, paragraph 1, of resolution no. 5 of 11 October 2023 has elapsed, the Sections shall decide on the initiation of disciplinary proceedings by 30 April 2024, for the removal from the ‘Register of those categories that do not have a suitable technical manager.

Once the 30-day period has elapsed without the company having appointed a new technical manager in possession of the required requirements, the regional and provincial sections of the Register will decide on the cancellation of the aforementioned categories pursuant to art. 20, paragraph 1, letter b) of Ministerial Decree 120/2014 and notify the interested party of the relevant provision by certified email.

When does it come into force?

The Circular came into force from the date of publication.

Operational indications

The technical manager must be in possession of the suitability requirement, consisting of demonstrating his preparation, through an initial check and subsequent five-year checks to guarantee the necessary updating.

The role of technical manager of waste management has today become fundamental for companies registered in the Register, without which they cannot operate and remain registered.
