Acquittal because the fact does not exist: the single judge of the Agrigento court, Nicoletta Sciarratta, confirmed the decision of the justice of the peace (after a visit to the Supreme Court which sent the file back to the court believing it did not have to decide) with which the former extraordinary commissioner of the former regional province, Benito Infurnari, had been acquitted.

The expert bureaucrat ended up on trial on charges of negligent bodily harm following a road accident in which a centaur who was a minor at the time was seriously injured after, according to him, falling from his scooter.

The trial arose from complaints from the boy who claimed to have had the accident due to the poor condition of the road surface.

In Infurnari, in particular, it was claimed “that the provincial road 68, indicated as via Nereo of the Municipality of Porto Empedocle, had not been made safe”. Furthermore, the road was dark, had a bumpy surface and “there were no danger signs”.

For this reason, according to the initial version of the prosecutor who investigated the trial, the boy, in 2014, aboard a scooter fell despite the moderate speed, hitting his face on the ground and causing serious trauma and several fractures to the nasal septum and jaw as well as to the loss of two incisors and several hematomas.

Already at first instance, the hearing prosecutor Salvatore Caradonna had asked for acquittal, claiming that certain proof of the accused’s responsibility had not been achieved. Conclusions that were opposed by the plaintiff’s lawyer Floriana Salamone who asked the judge for conviction and compensation.

Infurnari’s defender, Daniela Posante, had underlined that not even the scooter with which the accident occurred was ever identified and that the victim, on this point, had given three different versions given that the police had intervened only after the vehicle had been removed.

The lawyer had also argued that any responsibility could not be traced back to the political body. Only the civil party challenged the verdict which has now been confirmed with him being ordered to pay the costs.
