Bozzoli Murder, the Court of Cassation Confirms Giacomo’s Life Sentence

The first criminal section of the Court of Cassation confirmed the life sentence for Giacomo Bozzolithe forty-year-old convicted of killing his uncle Mario on the evening of 8 October 2015 in the family foundry in Marcheno.

The appeal advanced by the lawyers Luigi Frattini and Franco Coppi it was rejected. The conviction of Giacomo Bozzoli, not in the courtroom unlike the hearings held in Brescia, it therefore became definitive. The accusation

Therefore, what was requested by the Attorney General at the Court of Cassation was accepted: according to the prosecutor the two sentences which sentenced the 40-year-old from Marcheno to life imprisonment for the murder of his uncle Mario and the concealment of his body are free from defects, both from a formal and logical point of view.

It remains to be understood now whether Giacomo Bozzoli, who was awaiting the decision in his home on Lake Garda according to what was reported by his father Adelio, he will decide to turn himself in or wait for the police to arrive who will take him to prison to serve a life sentence.

The Marcheno mystery begins on the evening of 8 October 2015, when the 50-year-old entrepreneur Mario Bozzoli disappears into thin air from his foundry in Via Gitti. Since the 7.15pm phone call with his wife Irene Zubani, no one has heard anything about him.

A mystery that gives rise to complex and long investigations, complicated by the death of Giuseppe Ghirardini, the bakery worker who vanishes six days after his employer and who is found dead in Case di Viso with cyanide bait in the stomach.

First degree

The first instance sentence arrives on September 30, 2022 after 22 hearingsThe Court of Assizes of Brescia, presided over by Judge Roberto Spanò, after a deliberation lasting more than 24 hours, sentences Giacomo Bozzoli to life imprisonment.

The defense had asked for acquittal because “there is no evidence accusing Giacomo, but only evidence in his favor that categorically excludes that he could have attacked his uncle or had him attacked by others.”

Second degree

The Court of Assizes of Appeal instead expressed its opinion more than a year later: on 17 November 2023 the end of the sentence is confirmed for Mario’s nephew. Giacomo Adelio’s father shocked: «I don’t know what to say anymore» he declares as soon as he leaves the room.

Giuseppe Ghirardini, found lifeless in Case di Viso a week after Mario Bozzoli’s disappearance, according to the Court of Assizes of Appeal “played a key role in the murder” of the entrepreneur. In the reasons for the life sentence of his nephew, Giacomo Bozzoli, the judges write that Ghirardini may have destroyed Mario’s body in the oven.
