ROSETO. The Council of State has rejected the request for suspension of the Abruzzo Regional Administrative Court ruling on the 2023 Tari rates filed by the Municipality of Roseto on June 28. The hearing on the merits has been set for July 31. “The Regional Administrative Court had accepted the appeal presented by the associations of beach resort owners and tourism operators,” specifies the opposition councilor and group leader of the Free Progressives, Rosaria Ciancaionethe only one that had voted against the two contested resolutions, “also condemning the Municipality to pay legal costs since the annulled resolutions did not adequately justify the extraordinary circumstances that would have compromised the objectives indicated in the 2022-2025 economic-financial plan, with the consequent request to citizens for sums not due for the 2023 Tari”. The appeal of the beach resort operators concerned the payment of the variable portion of the Tari.
The Abruzzo Regional Administrative Court ruling on the 2023 Tari rates also mentions 900 thousand euros to be returned to citizens. “Instead of following the ruling, returning the greater sums requested to citizens,” adds Ciancaione, “the Municipality has appealed to the Council of State and, in addition to the legal costs to which it was sentenced by the Regional Administrative Court, it is spending the additional sum of 10 thousand euros divided with Agir, the integrated urban waste management authority, for the legal assignment.” There was also a heated controversy in the city council on the merits by opposition councilors, but the majority tried to minimize the effects of the Regional Administrative Court ruling. Councilor Ciancaione has been fighting the battle over Tari for years now, and recalls her motion approved in council in 2022 for the return of an additional 800 thousand euros to citizens following the TAR ruling in 2019. “In practice, the Nugnes administration continues to request greater sums on Tari, as well as for 2024,” concludes Ciancaione, “and does not return to citizens those not due, such as the 800 thousand euros of the 2018 Tari of my motion approved in council in 2022 following the TAR ruling in 2019, continuing to spend a lot of money on legal fees from convictions and defense fees. And then there is no money to put up a street lamp in via Nazario Sauro, in the section near the Felicioni hotel, which is completely dark, or to fix contrada Centovie, now impassable for years, or to replace the irrigation pump in Patrizi park in such a sultry summer.”
