Ballot between Petronella and Moramarco, Polis2030 appeal rejected

The Council of State of Rome has issued the sentence on the appeal presented by four city councilors of the Polis 2030 coalition on the victory by only 18 votes of the mayor Vitantonio Petronella in the run-off of the 2023 elections against the mayoral candidate Giovanni Moramarco. The Council of State rejected the appeal, judging it to be “unfounded” and essentially confirmed what had already been decided by the Bari Regional Administrative Court which had rejected the appeal in first instance.

The eight Polis2030 councilors had appealed to the Bari Regional Administrative Court. The appellant councilors contested alleged illegitimacy in the presentation of some lists and requested the annulment of the elections (won by Petronella with 18 votes less than Giovanni Moramarco) or the repetition of the electoral procedure with the exclusion of these lists. Alternatively, they had requested a recount of votes in some sections. The court had judged the appeal “inadmissible” from an administrative point of view and sent the documents to the Prosecutor’s Office for the criminal aspects.

At the second level the legal initiative was presented by four councillors. The outcome was the same: the appeal was not accepted. So everything stays as it is.
