“For the 4 years following the accident we couldn’t have a normal life.” This is what he claimed before the justice of the peace of the court of Lucca, the mother of the French child who on 21 August 2018, at the age of just 5 and a half yearsfell from the Walls on his rented bike, ending up in the gunboat of the San Regolo bastion. A fall of almost six meters which caused him serious injuries: that incident, as is now known, is at the center of a trial in which the child’s parents have sued the Municipality of Lucca as allegedly civilly responsible. As is now known, the French couple immediately filed a complaint. After a series of investigations, the judge established the compulsory indictment for the former president of the Opera delle Mura Alessandro Biancalana and two managers, Maurizio Tani and Giovanni Marchi, assisted by the lawyers Lodovica Giorgi, Carlo Di Bugno and Andrea Rugani, for negligent personal injury, despite the public prosecutor asking for it to be dismissed. The single judge, however, had held that jurisdiction over negligent injuries fell to the justice of the peace, where the proceedings were initiated.

In this morning’s hearing (24 June) the child’s parents were interviewed (while the other two friends of the couple who live in Dubai were unable to show up). Both gave their version of events but it was in particular the mother who argued that the family would not have been able to have a normal life for around 4 years following the episode, having to also resort to psychological support due to the shock caused by the accident in which both the child and the father were involved. The father of the child who was injured while helping his son also spoke. According to the thesis of the Municipality’s defense, the man would have been bruised by lowering himself from the other side of the parapet, from where the child on the bicycle had fallen. But this morning the father claimed something different. In fact, the man said that he fell immediately after his son: seeing the child fall – this is essentially his version of events given in court – he climbed onto the parapet and slipped due to the lack of protection. According to his story, therefore, the child’s father would have injured his shoulder in this way and not – as the Municipality’s defense claims – by lowering himself from the parapet, as other witnesses present at the time would claim to have done, one of whom would be a friend. of the couple.

Both parents they then argued that at the point of the accident, nor in the vicinity, there were signs warning of the danger of falling and, therefore, that they could not have in any way realized the risk that their son could have run. Not only. They also claimed that, while cycling along the promenade of the Walls, they had not realized the difference in height compared to the level of the terraces, because they had taken a climb to reach the walls which, in their opinion, was not so steep as to suggest dangers of fell from the parapet. Not knowing Lucca and walking along the Mura promenade for the first time, that is, they claimed that they had not been warned in any way by the signs that there was a danger of falling. This is also an aspect contested by the Municipality’s defense which claims instead that on the Walls there were signs in five foreign languages inviting caution and informing tourists and others of the danger of the fall.
Thesis that the Municipality’s lawyers will be able to assert themselves in the next rounds before the justice of the peace.
