VILLANOVA DEL GHEBBO (ROVIGO) – The failure to realize thecrematorium facility hypothesised in Villanova del Ghebbo, a small village a stone’s throw from Rovigo and the positions publicly supported by committees, technical consultants and others who expressed opposition will end up in court as a result of the summons from Altinia srl of Padua, which is asking for damages of over one million euros to eight subjects. The Padua company that had proposed the construction of the plant in the area identified in via Biagi, assisted by the lawyer Andrea De Checchi, sues for damages the “Environment and health protection of the Villanova del Ghebbo territory” committee, its president Cinzia Visentin and the members Floriano Oselin and Nicola Oselin, the committee’s lawyer Giorgio Destro, the committee’s environmental consultant Marina Lecis and Moreno Ferrari, president of the environmental coordination Terre Nostre Veneto. Among those cited is also the president of Cia Rovigo Erri Faccini, who in a meeting had defined the plant as an “ecommonster”.
Altinia asks the Court of Padua, identified by the company for territorial jurisdiction, to recognize damages estimated at over 1 million and 260 thousand euros. The figure is the sum of the 261,539 euros spent by Altinia for the presentation of the project financing proposal and the 998,618 euros of net present value that according to the company the project would have generated if completed, as certified in the financial economic plan. Altinia essentially holds the eight cited responsible for having disseminated “very untruthful news devoid of any scientific substratum regarding possible environmental impacts, allegedly harmful to health, related to the emissions produced by the planned plant”. Various statements are contested, some reported in press articles, others expressed in the public meeting of 20 December 2022, in which some citizens of Villanova and the municipal administration of the time took part, and in a conference organized by the committee on the evening of 18 March 2023. Statements which according to the company would have caused an “unjustified alarm” and for which those cited would have a “responsibility for having causally determined the decision of the municipal administration not to proceed with the award within the terms of the finance project procedure” . The quote speaks of a media impact that would hinder the continuation of the project.
The cause does not seem to worry some of those mentioned. The lawyer Giorgio Destro, lawyer of the Villanova del Ghebbo committee, will be defended by his colleague Serena Pomaro. «I am also surprised because the summons was not preceded by my colleague De Checchi, the lawyer of the plaintiff company, by the obligatory communication that he had received a mandate to take legal action against a colleague, as ethics requires. For this reason I have already filed a complaint against him with the Disciplinary Council of Veneto lawyers. I feel absolutely at ease having appointed my colleague Serena Pomaro of the Court of Padua, an expert in the matter, for my defense, who will demonstrate my absolute professional correctness in carrying out the defense activity in favor of clients and will request the rejection of the application with the request of compensation for damages for reckless litigation”. Environmental activist Moreno Ferrari’s comment on the matter was clear. «When have we ever seen a company cite environmentalists, technicians and lawyers who expose scientific data expressed by authoritative organizations and associations to citizens? It seems to me like a bluff carried out in an attempt to scare people.”
