Tuscany Region, the reform of the regulation for the awarding of sports facilities has been approved

The Regional Council unanimously approved the unified text of the law which reformulates the local implementing regulation for the assignment of the management of sports facilities.

The act, presented by the president of the Health Commission, has implemented and unified two legislative proposals, the one presented by the Democratic Party and the one presented by Forza Italia and modifies the regional law 21/2015.

The law updates the criteria for awarding sports facilities in the territories. The new regulation provides that the awarding of facilities takes place preferentially to amateur sports clubs and associations, sports promotion bodies, associated sports disciplines and national sports federations, as well as to temporary groupings between the aforementioned entities, according to publicly available procedures.

The legislation provides that when choosing the contractor, the history of the territory and the number of members of the sports federation must be taken into account, with particular reference to members of the youth sector; the historicity and state of maintenance of the systems including the removal of architectural barriers; the organizational methods of management and operation of the plant; of the custody, cleaning and maintenance services of the same for the purposes of evaluating the offers; of the sports qualifications held by the entity entrusted with the quality of the sports offer presented, with particular reference to youth activities; of the tariffs applied and access prices as well as economic reliability; the organization of activities aimed at young people, disabled people and the elderly; and again, the professional qualification of the instructors, coaches and technical staff used and the organizational methods of running, operating and maintaining the facility.

Two amendments were approved: the first modifies the evaluation clause already contained in regional law 21/2015 in order to provide that the annual report to be sent to the Council also includes information relating to the overall number, in addition to the already foreseen territorial distribution of the plants and equipment for physical activity; the legal nature of the entities entrusted with the sports facilities; the type of employment contracts applied in the context of assignments and the number of volunteers possibly working in sports facilities.

The second, which modifies the preamble, introduces a specific reference to the subsequent introduction of the constitutional reference to sporting activity and to the European Sports Charter, and contains important principles regarding the defense of human rights and the promotion of gender equality in sport and through sport. Specific provisions are also envisaged in relation to the active involvement of Third Sector bodies through forms of co-programming and co-planning and that of companies, associations and amateur sports bodies in the regeneration, redevelopment and modernization programs of sports facilities.

Also approved was an agenda presented by Democratic party which commits the Council to take action to ensure that sports work is protected in the regulations governing the methods of entrusting the management of sports facilities and in other implementing acts. There is a commitment to the maximum diffusion of the benefits of sports practice for people with disabilities, to ensure that the offer is strengthened throughout the territory and to promote and implement initiatives with people with disabilities that can contribute to emancipating them from psycho-physical-social point of view. There is also a commitment to relaunch the Sporthabile project, conceived by the Italian Paralympic Committee of Tuscany with the contribution of CONI and the Region. Finally, there is a commitment through the competent council commission to annually organize a discussion and sharing session with the most representative trade union organizations on the contents of the annual report required by law.
