Lazio Regional Administrative Court ruling upholds appeals against disputed plant

VITERBO – A very important victory for the environmental protection of Tuscia. The Province of Viterbo once again asserted its reasons before the Regional Administrative Court (Tar) of Lazio, managing together with the appellants – Municipalities of Tuscania, Tarquinia and Tessennano and some private individuals – to have all the documents relating to the plant annulled marine waste disposal.

The Lazio Regional Administrative Court, with a sentence published today, has in fact accepted the appeals presented by three Municipalities of Tuscia and by some residents and entrepreneurs of the area against the provision with which the Lazio Region – in May 2023 – had released to the private company Med Sea Litter Italia Srl environmental compatibility opinion to build a plant for the disposal of waste from the sea and beaches in Arlena di Castro.

The Administrative Court in fact recognized the motivations of the appellant Province and Municipalities, which together demonstrated how the authorization provisions issued by the Lazio Region had substantial and procedural flaws.

The Lazio Regional Administrative Court, at the end of a long judicial proceeding which also attracted the attention of public opinion, ruled in favor of the appellant Municipalities and the Province of Viterbo.

The sentence also recognizes the role of the Province, which is responsible in compliance with the powers provided for by the art. 197 TUA the identification ‘…of areas suitable for the location of waste disposal plants, as well as areas not suitable for the location of waste recovery and disposal plants’).

Furthermore, it is recalled how, with council resolution no. 12 of 19 January 2024, the Province issued the proposal for a provincial waste management plan, through which it established that the entire territory of the Municipality of Arlena di Castro is characterized by the presence of constraints that cannot be overcome (defined as ‘excluding factors ‘) for the construction of landfills.

Furthermore, the plant falls in an area declared by the Ministry of Culture to be of notable public interest with the effect that the Region will have to evaluate the project in light of the landscape restrictions established and the specific positions of the neighboring municipalities as well as the role of the Province in this regard. to the location of the systems.

‘Once again the Province of Viterbo has defended its territory and landscape – commented Alessandro Romoli, President of the Province of Viterbo -. The Tuscia area within which the landfill was intended to be built has been declared to be of notable public interest and has a strong agricultural, tourist and naturalistic vocation which could not and will never be compromised. Not only that, another message must also be conveyed to all levels of national politics: the Province of Viterbo is no one’s dumping ground, neither for the other provinces of Lazio nor for the rest of Italy.
