A few weeks ago, the report on the data of the first half of the activity of the DESC committed to combating illegalities relating mostly to the sphere of immigrants present in the territory of Palma Campania. In the last few hours, further numbers have to be added to these following further checks. Making even more news is the validation of the preventive seizure carried out by the Municipality of a property transformed into a makeshift dormitory. Following the inspection activity in the property located in the historic center of the city, in addition to the presence of numerous illegal immigrants, health and hygiene deficiencies and overcrowding, it was found that the property used as a makeshift dormitory was instead a place intended for activities commercial: a situation, the latter, which fully falls within the category of urban planning crimes.
In this case the municipality can, in the person of the local police commander, operate as a judicial police body on its own initiative or under delegation of the PM of the Nola prosecutor’s office. According to the facts, the municipality, in this specific case, acted on its own initiative by carrying out judicial functions aimed at repressing crimes perpetrated within the municipal territory. A great result which is added to those that have been imposed so far such as complaints, fines, reports to the police station: in this case the one who is further affected is the owner of the property who also risks ending up with even more severe penalties if discover further violations over time.
This initiative of preventive seizure of the property, although implemented by the municipal commander to prevent the illicit activity from continuing undisturbed, is necessary for it to be subjected to scrutiny of legitimacy by the investigating judge who decides (in the presence of reasons of urgency and potential continuation of the crime) for validation or not. Well, after just a few days, the validation from the Nola court arrived, signed by the investigating judge: an important signal that underlines even more how indispensable a control activity is that involves without distinction those who commit crimes to the detriment of the State, people and society. City .
