The latter, on which the carabinieri were travelling, was coming from the opposite direction and was regularly positioned in its own semi-lane when the impact caused Vigilante killed instantly and caused serious personal injuries to the 38-year-old next to her, who was transported by air ambulance to the Maggiore hospital in Bologna, with fractures of both wrists, dislocation of the right hip and right acetabulum, judged healable by doctors in over forty days. At the same time, the Prosecutor’s Office advanced archiving request – on which the preliminary hearing judge has yet to rule – for the 38-year-old PDM, too investigated for road homicide – as per practice – in the months following the accident, when the investigators asked for help from a consultantthe engineer Guido Cacciari, to carry out a kinematic technical consultancy to ascertain any responsibility for the fatal accident.

During the preliminary hearing, assisted by lawyer Denis Lovison, the 38-year-old policeman turned himself in civil party and sued the insurance company as civilly liable. The preliminary hearing judge will express his opinion on this aspect at the next hearing, which has been set for December 19th.
