If on the one hand, in fact, the State-Regions Conferenceyesterday morning, said no to the suspension of the Salerno professional from the position of president of the National Agency for regional health services, having not reached, with theopposition from the Campania and Puglia Regions, an agreement on the request made by Ministry of Health, on the other hand, if the agreement is not reached within thirty days, the Government can take action autonomously, justifying the decision. The agreements (art.3 of the legislative decree of 28 August 1997, n. 281) are expressed in all cases in which the legislation in force provides for an “agreement” to be sanctioned with the State-Regions Conference, on a proposed initiative of the central administration; consists of the determination agreed upon, unanimously, by the Government and of all the presidents of the Regions and autonomous Provinces, of the contents of the provisions themselves. In the event that an agreement is not reached, within thirty days of the first meeting in which the item is placed on the agenda, the Council of Ministers will provide a replacement, justifying the choice.
THE STORY
The State-Regions Conference already had to express its opinion on May 2nd regarding the Ministry of Health’s request for suspension from the office of president of Enrico Coscioni’s Agenas, on the Prime Minister’s draft decree, but had opted for a postponement. The decision of the President of the Council of Ministers had arrived a few days earlier, even before the judges of the Court of Review of Salerno decide on the appeal presented by the local Power of attorney precisely on the fact that the investigating judge, in deciding to ban the heart surgeon from practicing the medical profession for one year, had rejected the request for suspension as president of the public body and technical-scientific body due to the absence of the danger of evidentiary pollution in carrying out the role of president of the institution. But for the presidency of Cabinet, the facts accused of Coscioni in the exercise of the medical profession were «of such gravity as to have undoubted repercussions also on the role carried out by him as president of Agenas» and because Coscioni «is accused not only of serious errors in the exercise of the medical profession , which led to the death of a patient, but also to the crime of aggravated ideological forgery.” Hence the stop “until the date of settlement of the criminal trial and, in any case, until 28 October 2024”. The favorable opinion also came from the State Attorney General’s Office, for which «the institutional tasks of the Agency, the organic and functional position of its president and the specific acts contested against doctor Coscioni could highlight an inappropriateness of the continuation of the office ».
THE DEAD PATIENT
The case revolves around the death of a 62-year-old, Umberto Maddolo, entrepreneur from Montecorvino Rovella, operated at Ruggi by a team led by Coscioni. Hence the complaint from the family, which led, with the investigations, to the exhumation of the body, during which a 15 cm gauze was found, immediately seized by the police together with the medical records. Then, in February, the warning and the one-year suspension from medical activity.
The gauze “count” didn’t add up, but nothing came out of the instrumental investigations carried out. Even during the autopsy, carried out seven months after his death, it was not easy to find the “forgotten” gauze. Only with the examination of the organs was it possible to find it.
