We have received and published the letter to the Prefect from the centre-right representatives with the request for the administration of the Municipality of Alessandria.
Esteemed Prefect,
We are writing to express our concern in this regard to the approval of the 2023 Management Report of the Municipality of Alessandria of which we are administrators. The art. 227 paragraph 2bis of the TUEL provides that in case of non-approval of the management report by April 30th of the following year, yes applies the procedure provided for in paragraph 2 of article 141 for the dissolution of the Town Council. Said paragraph establishes that after the deadline within which the budget must be approved without the relevant budget having been prepared by the council scheme, the regional control body appoints a commissioner to ensure it prepare ex officio to submit it to the council. In this case and in any case when the board has not approved the financial statement prepared within the legal deadlines by the council, the regional control body assigns to the council, by letter notified to individual directors, a deadline of no more than 20 days for its approval, after which he is replaced, by means of a specific commissioner, to the defaulting administration. The replacement provision is given communication to the prefect that the procedure for dissolving the council begins.
Currently, unlike what happened in the case of slight delays in passed, the Council did not even deliver the complete Management Report all mandatory attachments, including the auditor’s report accountant, from which time the City Council must be given 20 days to examination of the reporting format and attachments. And consequently, what even more serious, a date for convening the Council was not identified and communicated Municipality which will have to vote on the 2023 Management Report of our institution. Today we find ourselves asking for your authoritative intervention to protect the our body which is as of May 10th without a complete reporting scheme of the mandatory attachments when the deadline for delivery to the City Council it should be April 10th to allow the City Council to approve it by April 30th as required by the regulatory provisions.
We would also like to point out that our concerns are also due to the fact that in recent months there have been three changes in the role of Director of the sFinancial Resources, Planning and Budget department of the entity of which the latter designated by an act – union decree 16 of 04/16/2024 – in our opinion illegitimate, with consequent presumed nullity or annulability of the acts adopted by manager.
As you can see from these lines, our concerns are absolutely founded so much as to push us towards this serious act of turning to the SV in order to verify the opportunity of a commissioner aimed at re-establishing legitimacy, correctness and certainty of our institution’s accounts.
