The accused, defended by the lawyer Fabio Fiore of Varese, was cleared of the charges for two reasons.

First of all, his working status excludes him from that of “public service employee” in which the possible accusation of embezzlement would fall, an accusation therefore reduced to the more minor crime of embezzlement.

And here is the second reason of not having to prosecute criminally: the admissibility requirement is in fact guaranteed by the presence of a complaint, which is missing.
