In the absence of exhaustive legislation, with the Meloni government which makes melina and after yet another pronunciation of State Council for the tendering of beach concessions, chaos reigns supreme in the sector. A few weeks before the start of the summer season, the orientations are different and often conflicting. Today the Tar of Bari declared the tender procedure for 21 factories in Monopoli illegitimate, establishing the extension of concessions to 2033. A choice that contrasts with the ruling of the higher administrative body, namely the Council of State. The lawyer who defended the reasons of 21 establishments comments: “The Monopoli case demonstrates that today, in light of European law, there is no need to call for tenders for concessions.”

The next meeting of the government technical table on this dossier is therefore scheduled for June 12th after the European elections, and in a limited format, with technicians from the ministries and representatives from the regions, but without those from the category. The aim is the “definition of the works following the dialogue with the European Commission“, which at the moment, however, has not yet led to results. The executive is looking for a solution to prevent the infringement procedure, for violation of the Bolkestein Directive, arrives before the European Court of Justice, but there would not be full agreement among the allies on how to act.

As is now known, everything is played around the notion of scarcity of the good, in this case the beaches to be given under concession. If they are such, the European standards provide for tendering. Otherwise it is not necessary. Hence the mapping operation launched by the government, also to save time. The first reconnaissance was considered unreliable by Brussels as it was carried out with extremely arbitrary criteria. A second reconnaissance is now underway.

In many cases i annual fees are negligible. According to a report from the Court of Auditors, the State collects just 92 million euros every year from over 12 thousand concessions. An average of approx 7.60o euros per plant, based on estimated average turnovers in 260 thousand euros. Last December the Ministry of Infrastructure, led by Matteo Salvinihas decided to further reduce the fees by 4.5%.

The dossier is in the hands of the ministers Raffaele Fitto (European Affairs) e Matteo Salvini (Infrastructure), and there is between the two misalignment on strategy, as the majority also recognize. For this reason too, the dialogue with Brussels is not making great progress at the moment. The municipalities move in no particular order. There are those who postpone the decision, those who extend the concessions and those who proceed to tenders for those that have expired. This is the case of the Venetian municipality of Jesolo where the new assignments were won by new concessionaires. The old managers, however, are making a wall: they have sealed the sheds with i Toilet hey kiosks for catering.
