At the Review, the defenses of Festa and Guerriero ask for the investigating judge’s order to be null and void

AVELLINO – It is one of the longest days for the “Dolce Vita” investigation, in particular for the decision of the judges of the Eighth Section of the Court of Freedom on the precautionary measure applied last April 18 to the former mayor Gianluca Festa and to architect Fabio Guerriero. The outcome could arrive in the next few hours. Meanwhile, before the magistrates of the Eighth Section of the Court of Review of Naples, including the prosecutor of the Avellino Public Prosecutor’s Office Vincenzo Toscano, the defense of Guerriero and Festa, the criminal lawyers Marino Capone, Luigi Petrillo and Nicola Quatrano, led to the attention of the judges of the Court of Liberty a series of issues. An objection of nullity was shared by all the defenders, which concerns the lack of access by the defense to the audio and video recordings relating to the precautionary measure. For the lawyers, a defensive injury which would determine, also in light of a Supreme Court ruling of January 2024, the nullity of the documents. But that’s obviously not the only issue. Guerriero’s defence, which would also have motivated the choice not to answer the warrant interrogation precisely by this impossibility of knowing the full picture of the accusations, would also have noted how the crime and the paragraph to be contested (not to private individuals like Guerriero) it was 326 paragraph 1 and also in terms of precautionary needs, as the professional himself had no relationship with the Municipality of Avellino. Precautionary requirements and circumstantial framework which were also censored by the defense of the former mayor Festa.
