Fraudulent bankruptcy and tax debts: entrepreneur arrested in Modena

Modena, 4 May 2024 – Fraudulent bankruptcyissue of invoices for non-existent operations and concealment of accounting records: these are the charges weighing on an entrepreneur from Modena for whom the Guardia di Finanza has implemented an order issued by the investigating judge of the Court applying for precautionary custody in prison.

Following the declaration of bankruptcy of a company operating in the meat processing sector and following a detailed investigative activity coordinated by the Prosecutor’s Office and conducted by the military of the Modena economic-financial police unit, the the illicit conduct contested against the dominus of the company and, by extending the investigations to two further companies attributable to the same entrepreneur and equally declared bankrupt, a total bankruptcy liability of almost 3.5 million euros was ascertained (almost entirely for debts towards the Treasury), as well as the diversion from company funds of over 1.3 million euros, through frequent and significant unjustified cash withdrawals.

The investigations, as well as rediscovering the lack of accounting documentationdeliberately hidden in order to prevent a precise reconstruction of the corporate events, they highlighted how the suspect used another companyde facto non-operational, to issue false invoices for several hundred thousand euros. The confirmed systematic violation of bankruptcy and tax regulations, which in the accusatory charge includes the period from 2019 to 2023, was considered indicative of the existence of the precautionary need of the danger of recurrence of the criminal conduct and determined this Prosecutor’s Office to request the application of the most serious of the precautionary measures.
