What happened in Lombardy regarding those excluded from the inclusion allowance?

In Lombardy, following the reform that introduced the inclusion allowance (Adi) instead of the citizen’s income, there was a major bureaucratic hitch which is preventing disadvantaged families from receiving the benefit they are entitled to.

This problem arose because in the Region the ASSTs (Territorial Social Health Authorities) they are not connected to local Health Protection Companies (ATS), a structural difference not considered by the reform nor by ministerial and INPS circulars.

Social and health services must certify, via an online service provided by INPS, the disadvantaged conditions of people and care and assistance programmes within sixty days. However, this system does not work for the Lombardy ASSTs, since the operators cannot access the procedure and thus the disbursement of the subsidy is blocked.

What is the inclusion allowance?

L’Inclusion Allowance (ADI) it is a measure introduced at national level with the aim of combating poverty, vulnerability and social exclusion of the weakest people.

This measure promotes social and professional inclusion paths, training and active employment policies, and was established starting from 1 January 2024.

The ADI was defined by article 1 of the Legislative Decree of 4 May 2023, number 48, which was subsequently converted with amendments by the Law of 3 July 2023, number 85.

This benefit offers a financial support and facilitates social and professional inclusion. It is conditional on verifying the family’s financial means and adhering to a personalized social and work activation program.

This support is divided into two parts:

  • A supplement to family income up to a certain limit (quote A)
  • Specific help for families residing in a rented home with a regularly registered contract (quote B)

Who are the people considered to be at a disadvantage?

They are considered in disadvantaged conditions different categories of people who need specific support. These include people with mental disorders or addictions, victims of trafficking or gender violence, people with physical, mental or sensory disabilities with a degree of disability between 46% and 66%, ex-prisoners or those who are subject to alternative measures to detention, and individuals facing extreme housing difficulties such as homelessness.

These people must be in charge of health or social services or involved in integrated care pathways.

A declaration of disadvantage is not required for minors, elderly people over 60, or people with disabilities already considered fragile according to the ISEE criteria, nor for families with a single adult and vulnerable members.

How can the disadvantaged situation be certified?

There disadvantaged condition it is defined on the basis of the objectives and duration of the interventions and services included in the plans to support autonomy or in the individual assistance projects, managed by the social or socio-health administrations.

When applying for the Inclusion Allowance, the applicant must self-certify your disadvantaged status providing details such as the body that issued the certification, the identification number (if available), the date of issue and confirmation of having been taken care of and included in a personalized project or in a treatment program, specifying also the responsible body if different from the one that issued the certification.

This certification must already be in place and valid at the time of submitting the application, and serves to establish eligibility for the economic benefit of the Inclusion Allowance.

How does the inclusion allowance work?

The economic benefit expected from the ADI begins to run from the following month to the one in which the applicant signs the Family Unit Digital Activation Agreement (PAD), provided that the investigation is concluded with a positive outcome.

The benefit is paid every month through an electronic payment card (Inclusion Card or ADI Card) for a period of time maximum period of 18 consecutive months, with the possibility of 12-month renewals after a one-month break. After each 12-month renewal cycle, there is a one-month break.

The amount intended to supplement family income can be dividedupon request during the submission of the application or subsequently, among the adult members of the family unit who have parental responsibilities or are included in the ADI equivalence scale, assigning each their own share.

When do the inclusion allowance payments take place?

From 27 February 2024, INPS began to pay the February 2024 monthly payment for families who submitted an application by January 2024 and who have already received payments on 26 January or 15 February, provided that the requirements to receive the check are still met.

The dpayment dates following the first dispensing are programmed as follows:

  • March 27, 2024
  • April 26, 2024
  • May 28, 2024
  • June 27, 2024
  • July 27, 2024

For applications submitted by February 2024 with the PAD signed in the same month, the first payment will be made on March 15, with the April monthly payment paid on April 26.

Applications submitted starting from February will see payments recognized from the month following the signing of the PAD, following the positive outcome of the investigation.

The payment dates for future applications, once the investigation is positive and the PAD is signed, are scheduled as follows:

  • For February 2024 applications, the first payment will be March 15, 2024.
  • For March 2024 applications, the first payment will be April 16, 2024.
  • For April 2024 applications, the first payment will be May 15, 2024.
  • For May 2024 applications, the first payment will be June 15, 2024.
  • For June 2024 applications, the first payment will be July 16, 2024.

FAQ on excluded from the inclusion allowance

Who is not entitled to the inclusion allowance?

A family unit cannot receive the inclusion allowance in the 12 months following the date of resignation if one of its members is unemployed because he left his job voluntarily. However, resignations for just cause and consensual terminations of the employment contract which occur through a conciliation procedure provided for by law are excluded from this rule.

When will the inclusion allowance be lost?

The inclusion allowance is temporarily suspended during contractual employment periods of up to six months, but is reinstated upon their conclusion.

What to do if the application for the inclusion allowance is rejected?

The request for review must be forwarded to the INPS office competent for the territory within 30 days of notification of the result. It is also possible to make a legal appeal.
