Agrigento, Di Leo remains prosecutor in the City of Temples

The Lazio Regional Administrative Court rejected the appeal presented by the Sciacca prosecutor Roberta Buzzolani against the appointment of Giovanni Di Leo as Prosecutor of Agrigento. Buzzolani, who ran for the post of head of the public prosecutor’s office in the city of temples, was also sentenced to pay the costs of the trial.

According to the Administrative Court, the CSM’s decision to appoint Di Leo «was based on a not illogical global judgment on the personality of the chosen one, within which his broad and more varied judicial experience was appreciated (moreover, longer than six years compared to that of the appellant)”. «In fact, the CSM – writes the TAR in the motivation of the provision – considered that the nominee has experience both in the civil sector and (mainly) in the criminal sector, having carried out judging and prosecuting functions in first instance offices and at the Supreme Court of Cassation”.

The judges maintain that the CSM, instead of using the automatism according to which Buzzolani as a prosecutor had more qualifications than her colleague, «with strengthened and entirely plausible motivation, decided to valorise the varied previous activity of the other interested party, the diversity of degrees in which the latter carried out the functions, together with the results achieved over the course of his long career”.
