Caserta, guarantor of prisoners: the flop of applications

The announcement published twice by the Province of Caserta – and twice deserted – regarding the appointment of a Guarantor of the rights of people detained and deprived of personal liberty, remained a dead letter”, a position that has been empty since 4 July last year after the resignation of Emanuela Belcuore, who resigned due to the well-known judicial affair. The nomination was given to her by President Giorgio Magliocca in June 2020. She was appointed after a public notice and on the basis of her CV after having “acquired the applications of interested parties, as per public notice dated 26 May 2020”.

Applications which this time, after the search for a replacement on the basis of the publication of two notices, did not arrive even from those who had previously submitted them, a sign that the task no longer attracts volunteers (who only receive a reimbursement of expenses ) or is no longer attractive for other reasons. It is difficult to interpret the flop: the Regional Guarantor Samuele Ciambriello does not comment, preferring “a religious silence”. For the president of the Criminal Chamber, Alberto Martucci, «the role of the Ombudsman for prisoners requires dedication and will to protect the rights of those who are considered by many to be “the last” in our society. Evidently, in this historical and social moment there is no interest in carrying out such a delicate task of solidarity and help towards those who have been relegated to a place of suffering and marginalization”.

Meanwhile, regarding the protection of prisoners, Ciambriello has already taken action by receiving the mother of the prisoner who the other day showed up in the courtroom at his trial with a swollen face. The 45-year-old from Capua, with drug addiction problems, had declared in court that he had been beaten in Secondigliano prison by several well-identified people. In this regard, the Regional Guarantor has already asked that the man be transferred to another prison while the judiciary takes its course on the beating. Speaking of violence in prison, the case of the beatings that occurred in the Santa Maria Capua Vetere prison on 6 April 2020 by several prison officers currently on trial, ended up the other day in the report of the Department of State for Democracy and human rights of the United States «Country Reports Human Rights Practices Italy», which cites other cases of violations in Italy and around the world.
