The prosecutor asks for it to be dismissed, but the complainant opposes it. It will therefore be the judge of the preliminary hearings who will decide whether or not to send to trial a lawyer from the Marsala Court investigated for perjury (a crime which the law punishes with imprisonment from two to six years). The offending party in the proceedings is the Marsala entrepreneur Michele Foderà (former owner of Sicilfert).

It was he who, in early June 2022, filed a complaint with the Prosecutor’s Office. “He gave false testimony in my civil case and made me lose it” the entrepreneur essentially stated. “And with the lawsuit – he continued in the complaint – I also lost the compensation for damages, part of which was represented by the legal costs for a lawyer from my firm”.

In support of his accusation, the entrepreneur cited some testimonies, attaching the minutes of the hearing, given in the criminal trial relating to the fact in question. That is, an alleged threatening gesture by the entrepreneur (gesture of crossed wrists as if to imply handcuffs) against another person while he was waiting in the lawyer’s office, who according to some testimonies arrived after the fact. While in the civil trial, in February 2022, the lawyer reported said that he was present at that moment. For the accuser, the proof of what he claims is in the cards.

In short, the proof would be clear. And also for this reason, the complaint was also presented to the disciplinary council of the Bar Association. The deputy prosecutor Stefania Tredici, however, asked the investigating judge to dismiss the criminal proceedings. Dismissal which was opposed, explaining why, by Michele Foderà, who is assisted by the lawyer Vincenzo Forti.

“After the request for dismissal – declares Michele Foderà – I had my lawyer read the file and I must recognize that Vincenzo Forti, before being a lawyer, is a sociologist, psychologist, anthropologist because he had foreseen everything, including the details and, as we know, that the devil hides in the details.”
