TREVISO – Non-approved speed cameras, in Veneto at risk of fines amounting to millions of euros. Fines for speeding on the roads using equipment identical to those adopted by the Municipality of Treviso, on the Ring Road, could be cancelled. This is the picture that would emerge after the ruling of the Court of Cassation which accepted the appeal of a lawyer from Treviso who, as a motorist, had received a fine for speeding at 97 kilometers per hour on the road where the limit is 90. The applicant’s initiative was also taken in light of a dispute that arose two years ago between the justice of the peace, to whom a previous fined driver had turned, and the ordinary judiciary, during the progress of which had resulted in conflicting pronouncements.

Non-approved speed cameras, the regulatory vacuum

The Supreme Court’s reasons lie in the fact that the equipment would have been authorized by the Ministry of Infrastructure but not subjected by the Government itself to a more detailed technical verification necessary for their approval. There would essentially be a regulatory void which, in the absence of corrections, would protect from pecuniary consequences from now on motorists caught by speed cameras for now considered non-regulatory.

The figures

As regards the public finances of Veneto, on average the fines for traffic violations are worth around 50 million a year And a third of them are attributable to exceeding speed limits detected by electronic equipment. The fee normally collected by the Municipality of Treviso would be just under 4 million.
