Vincenzo Malvaso waived the statute of limitations during the trial which took place yesterday in Rome before the judges of the Court of Appeal. The former Forza Italia exponent, defended by the lawyer Renato Archidiacono, is accused together with the former Urban Planning councilor of the Municipality of Latina Giuseppe Di Rubbo, current provincial coordinator of Forza Italia. During the previous hearing, the acquittal of the preliminary hearing judge of the Court of Latina was obtained – at the request of Vincenzo Malvaso’s defense – confirmed by the Court of Appeal for abandoning the appeal of the general prosecutor’s office in the Olimpia trial, where Malvaso was accused.

The TAR ruling which annulled the demolition order of the building was also obtained. The trial concerns the investigation of the Borgo Piave Variation, the defense had challenged the sentence issued in July 2017 by the judge of the Court Pierpaolo Bortone which had led to the sentence of one year and eight months of imprisonment for the former councilor of Forza Italia Vincenzo Malvaso and one year for the former urban planning councilor Giuseppe Di Rubbo. The alleged charges are: abuse of office and violation of urban planning regulations. The investigation was conducted by the public prosecutor Gregorio Capasso, owner of the file, and led to the seizure of the building located at the entrance to the capital. The investigations were conducted by the Forestry Department’s Nipaf and the subsequent checks were carried out by the technical officials of the Lazio Region during an inspection where the illegitimacy of the plan approval procedure came to light. “The violation of the law consisted in the failure to comply with a clear rule”, wrote judge Pierpaolo Bortone in the reasons for the sentence.

Also in the motivations, the entire history of the northern area of ​​the city was retraced, starting from the PPE of Borgo Piave, taking into consideration a resolution of the City Council of 1987 from that historical period until 2012.
The hearing in the Court of Appeal resumes on September 16th.
