A very energetic speech from Sergio Mattarella yesterday: «The CSM is called upon to contribute to ensuring maximum credibility for the judiciary, with decisions always taken with the sense of the institutions. Our fellow citizens demand transparent and efficient justice.” A scolding, always in Mattrelli style obviously. Which arrives during the naming ceremony of the Council seat after Vittorio Bachelet. «The members of the CSM are distinguished only by their “origin” – added the Head of State – and are called upon to carry out their mandate without having to worry about seeking consensus for themselves or for other subjects». In short, the politicization of the self-governing body of the officials is for Mattarella a problem that must be highlighted and overcome. Which comes from afar, of course, but which still concerns the establishment of Piazza Indipendenza. Mattarella remembers the jurist murdered by the Red Brigades on a terrible morning on the stairs of the law faculty at the University of Rome and speaks of him – former president of Catholic Action who was also vice-president of the self-governing body of magistrates – as a figure who he combined “firmness of principles and willingness to dialogue in the search for convergence between different perspectives”.

THE STRONGHOLD

Here, the CSM must not be experienced as a political stronghold but as a place of institutional dialogue and transparency towards citizens. The composition of diversity, Mattarella warns in the ceremony, «is not achieved by resorting to exchange logics, which ensure the interest of individuals or groups. Such a method would represent the denial of democratic pluralism, which inspires our republican institutions and which Vittorio Bachelet has always promoted.” It is a criticism of politicization and currentism. In the misguided search for popularity and woe betide practicing exchange logic.

The Head of State says these things in front of Vice President Fabio Pinelli, the members of the CSM and Bachelet’s family. A life dedicated to the “highest sense of politics at the service of institutions”, that of Bachelet. Who was murdered by red terrorists at Sapienza University on 12 February 1980, at the end of a lesson, while he was in the company of his assistant Rosy Bindi. «The Constitution and the sense of community for social cohesion have always overcome attempts to tear apart society and dismantle its institutions», insists Mattarella.

When he talks about the members of the CSM who are distinguished only by their “origin”, he is talking about lay people and professional figures. Of the former who are political appointees and the latter who are togas. And there are those who interpret Mattarella’s very critical speech as more aimed at the former than the latter. The fact is that the Head of State insists on the CSM’s dutiful respect for “the constitutional dictate, always making the pursuit of the general interest prevail”.

The vice-president of the CSM, Pinelli, says he appreciates Mattarella’s words, thanks him and observes: «Every magistrate must feel the duty to safeguard, in the daily exercise of his function, citizens’ trust in justice. Balance, sobriety of behavior inside and outside the courtroom, prudence and rigor in the interpretation of the law, professional ability always monitored and enriched, are the indispensable traits of the magistrate of today and tomorrow, the set of methods for the correct exercise of function”. And again: «The pride of being a magistrate, the vocation to serve the country in the name of the Italian people, also implies its reverse, since the community expects more from magistrates than it asks of those who are in any case invested with public functions».

YESTERDAY TODAY

In short, Mattarella’s intent was to cross-reference his portrait of Bachelet with today’s times. His references are clear. If Bachelet was “the man of dialogue, which more than a method is the essence of democracy”, and he had also become the protagonist of this at the CSM, after having been elected with only one vote difference compared to Giovanni Conso, that method should always apply to politics. «In those dramatic years – says Mattarella – Bachelet expressed the belief that the strengthening of democratic institutions was achieved not through conflict, but with choices, shared as much as possible, of full and coherent implementation of the principles of our Constitution». Only one path, therefore, that of the Charter. And not that of partisanship. Mattarella, as president of the CSM as well as the nation’s referee, is particularly passionate and reactive on this point. He reiterates that “the independence of jurisdiction is an indispensable value of our democracy”.
