There is also one of the biggest nightmares for every motorist administrative detention. Being faced with this penalty is unpleasant for each of us, given that none of us would like to see ourselves deprived from one day to the next of the possibility of driving our vehicle for a more or less long period. But what are the reasons that can lead the authorities to place an administrative arrest against a motorist?
Very often, what causes this unpleasant and uncomfortable situation is the failure to pay certain taxes. Among these we can also find the car tax, which as we know is an annual tax that is paid solely on the possession of a vehicle, regardless of whether it is in circulation or not. Not paying the stamp means not complying with the lawregardless of how unfair one may find it, and among the consequences that each of us can face there is also administrative detention.
In fact, when there are unpaid credits, the administrations and law enforcement agencies can block a vehicle. This means that for a certain period of time we will no longer be able to use the vehicle.
Administrative detention, in this case you risk nothing
Sometimes it may happen that administrations transcribe some practices in the wrong way. It therefore means that the citizen is asked for sums that are not due. In this situation, however, it is the latter who must demonstrate that he is in the right to abolish the administrative detention and to be able to drive his vehicle again as soon as possible.
However, when the motorist is found to be at fault, he can still save himself from administrative detention, but he must do so within the 30 days. This is when the vehicle is used for own profession either for the debtor’s business, or for the transport of people with disabilities.
Administrative detention and payment in installments, what the law says
In the cases mentioned above, the administrative arrest cannot be made and the authorities will proceed with its free cancellation. Furthermore, you can also request cancellation of the same if the vehicle was sold on a date prior to the start of the procedure.
Then there is the case of payments in installments: after the first payment, you can block the administrative detention and return to driving your vehicle as soon as possible.
