USA, the Supreme Court ruling on Trump’s immunity: the decision

In a recently released opinion, the Supreme Court ruled by a majority of 6 to 3 that Donald Trump is entitled to “some level” of immunity in the case of the violence of January 6, 2021. According to the majority of the justices, immunity should be recognized for official acts performed in the exercise of presidential duties, but not for private acts. The case was then sent back to the lower appeals courts in Washington, which will have to decide how to apply the decision to Trump’s case.

The Washington Court of Appeals had previously rejected Trump’s request for immunity. The six conservative judges voted in favor of this decision, with the opposition of the three progressive judges. The Supreme Court’s decision makes the possibility that the former president could be tried before the November elections for his alleged responsibility in the January 6, 2021 assault on Capitol Hill more remote. The Supreme Court’s ruling rejects a ruling by the Supreme Court federal appeal which in February had established that Trump should not have enjoyed immunity from what he did to counter the results of the 2020 elections which led to the victory of current President Joe Biden.
