The Tar of the Lazio accepted the appeal of the Port System Authority of the Southern Adriatic Sea, canceling for “absolute lack of attribution” the measures adopted by the ASI Consortium regarding the coastal deposit of liquefied natural gas proposed by Edison.

The sentence

In the rather substantial sentence (29 pages) the Administrative Court addresses the issue of the distance between the Costa Morena Est tracks and the Edison structure: with two notes (dated 10 and 17 January this year) the ASI had asked to respect a distance of at least 30 meters according to the decree of the President of the Republic 753 of 1980, while for the port authority and the energy company that of 5 meters would be sufficient, as provided for in the inter-ministerial decree of August 2022, approved by the Ministry for the Environment and Infrastructure, also at the center of the debate in politics and civil society.
The decision was taken in last Wednesday’s session: according to the judges, the contested provisions are void because they were adopted, as mentioned, in “absolute lack of attribution”, or without having the necessary powers because the notes would go beyond the competences assigned to the Consortium by the legislation, “however limited to the consortium perimeter, essentially aimed at the infrastructure of the areas falling within the aforementioned perimeter and the provision of services to businesses, with the exclusion of duties relating to urban planning and construction supervision”.
