John Elkann wins a round against her mother Margherita Agnelli on the story of the Agnelli inheritance and the secrets of the family safe. A round in the civil court, which concerned precisely the methods for registering December’s shareholders in the business register. According to the judges, the registration of John, Lapo and Ginevra as partners is legal and they rejected Margherita’s appeal.
December, established in 1984 to ensure control of the former Fiat empire, is also at the center of the criminal investigation for fraud against the state. For this thread, however, we start from when, in 2021, Margherita had filed documents useful to shed light on the dynamics of the company, which never appeared to have updated financial statements, articles of association and other documents. As a consequence, the membership rights of the three children had been cancelled, with the effect of formally returning the company to the hands of the previous shareholders, who however had long since died. Elkann then filed a notarial declaration certifying the transfer of shares, including donations from Marella Agnelli to her grandchildren.
Precisely those donations that, between suspicious signatures and failed transfers of money, the lawyer’s daughter contests on the criminal front: Marella’s fictitious Swiss residence would not have allowed either those donations or the testamentary documents. Margherita asked for those steps to be cancelled, but at least here she didn’t get her point. It remains to be seen whether and how much this step will also influence the criminal investigation.
