“In recent days the Rome court – prevention measures section – they say in a note from the police headquarters – issued the prevention measure of special surveillance against a forty-eight year old Italian for threats and violent behavior directed at his ex-partners, with start of the procedure for applying the electronic bracelet.

The man, already the recipient of the prevention measure of the police commissioner’s warning, who also had his driving license withdrawn for being a drug user, demonstrated recurrent oppressive attitudes towards the women with whom he had established romantic relationships.

On one occasion, at the end of a relationship with a woman which lasted four years, the man lurked near the places frequented by her, forcing her to change her lifestyle habits and to be accompanied by relatives or friends in her travels, so as not to remain alone, going so far as to take away her mobile phone and address her with offensive epithets also aimed at her daughter.

In a subsequent relationship, the man was arrested for mistreating his new partner by continuously insulting her with unrepeatable terms, isolating her from her family of origin.

During one of these episodes the man, after chasing the woman with her newborn daughter in her arms, yanked her by the neck, yelling at her, taking away and damaging her mobile phone to prevent her from seeking help, threatening her with death several times .

The subject’s oppressive and violent conduct, repeated towards the women with whom he established an emotional relationship, is considered particularly serious and current – recurring attitudes whenever the victims expressed the intention to end the relationships – following a scrupulous investigation carried out by the state police personnel of the anti-crime division, at the request of the Viterbo police commissioner, the prevention measure of special surveillance was issued against him for a period of one year, with application of the electronic bracelet.

The man will also have to observe a series of requirements including the obligation not to return home in the evening later than 9pm and not to go out in the morning before 6.30am, not to participate in public meetings, not to keep weapons and to not to associate with people who have been convicted or subjected to prevention or safety measures and to keep a distance of no less than 500 meters from the last victim and not to communicate in any way with the same.

Precisely to monitor compliance with this last requirement, the electronic bracelet was applied: the device, which cannot be removed except by the public authority, works with an alarm that is triggered if the holder approaches the victim, exceeding the established perimeter by the judge. Failure to comply with the requirements and obligations of special surveillance is punished by arrest.”

In the Italian criminal system the presumption of innocence applies until the final sentence. Presumption of innocence which is based on article 27 of the Italian constitution according to which a person “is not considered guilty until finally convicted”.
