The cursed evening is Sunday 30 January 2022. That evening Elena Russo, twenty years old, died in San Bartolomeo di Reggio Emilia due to a road accident. The Fiat Punto with which the girl delivered pizzas to homes – owned by the takeaway pizzeria for which she worked – went off the road in via Adelmo Tirabassi, overturning several times and ending up against a pole. The young woman also worked as a delivery girl in the evenings and on weekends to pay for university: she was enrolled in the second year of the faculty of law in Modena. In addition to studying, she was a volunteer at the Red Cross: it was her rescue companions who had the task of recognizing her after the accident, noting that there was nothing more that could be done for her.
Now there is a possible turning point in the case, after a rejected request for dismissal and a new investigation. During the investigation into his death, it emerged that the tires of that car were worn and not up to standard: in particular, two tires dated back, one 16 years old, the other 8 years old, making them older than the car itself. Those deteriorated tires may have played a role in the accident: this point will need to be clarified. The tire problem was identified in a report by Mattia Strangi, an engineer and consultant appointed by the court.
The fact is that the judge for preliminary investigations, Andrea Rat, ordered the Reggio Emilia prosecutor’s office to formulate the forced indictment against the two legal representatives of the pizzeria. In practical terms it means that the judge ordered the prosecutor Stefano Finocchiaro to continue with the criminal action, returning the documents to the prosecutor’s office: now the public prosecutor has 10 days to reformulate the charge and send the two suspects to trial ( risk being prosecuted for manslaughter).
There could be a case of accident at work with fatal consequences resulting from a violation of safety regulations due to the condition of the tires, which are worn to the point that they do not guarantee adequate grip on the road. For now, parole is a must.

The question of the speed at which the twenty-year-old was traveling that evening remains open. This is the main thesis in the hands of defense lawyer Nino Giordano Ruffini, who assists the two owners of the pizzeria. According to the defense consultant, Elena Russo was traveling at around 130 kilometers per hour at a point where the limit is 50. Only the speed exceeding the limit would have had a decisive causal role in the fatal accident, according to the defense, and not the conditions of the vehicle. According to the expert appointed by the victim’s parents, however, the speed would have been no more than 50 kilometers per hour, because the darkness of that January evening and the conditions of the road (a narrow country road) would not have allowed it to go any further. Now in the process any responsibilities will have to be established.
