In fact, if Salis were to miss the election, his situation in Hungary could worsen. The government has already sided with its judiciary on the occasion of the controversies between Rome and Budapest. And without a seat the political issue could worsen. Because at that point it could be argued that Salis does not have the necessary consensus even in Italy. And this could only worsen his position in Hungary. In recent weeks, Foreign Minister Antonio Tajani had also warned of the dangers of politicizing the case. Precisely speaking of the rumors that wanted her to be a candidate in the Democratic Party due to Elly Schlein’s decision. Among other things, the President of the Republic Sergio Mattarella was informed of her candidacy, who had telephoned her father: «he knew in advance how his role deserves her», Roberto specifies today. Because «Mattarella behaved with her like an affectionate grandfather and Ilaria didn’t want to cause him any embarrassment».

In case of election

But even in the event of election, release from prison would not be automatic. Indeed, according to Claudio Martinelli, professor of comparative law at the University of Milan Bicocca, the case could become even more intricate. The professor tells the Sheet that it is true that once elected Salis would acquire the status of MEP, “but at that point the collaboration of the Hungarian authorities would be necessary”. Instead, they could start a procedure to request the revocation of immunity immediately after the proclamation. “At that point Hungary could decide not to release her until the European Parliament responds to the request to revoke her immunity,” adds Martinelli. And keep her in prison.

The revocation

The revocation procedure could take a few months. And the response would largely depend on the political situation of parliament. Even if the request for revocation is rejected, adds Martinelli, “the Hungarian authorities could carry out obstructionist maneuvers, above all to slow down the release times”. Particularly for a case that has such a high politicization context. The candidacy therefore ends up moving the case from judicial to political. With all the unknowns that this entails.
