THE CASE
A transaction of 200 thousand euros, compared to a certain fate of 573 thousand euros, plus legal expenses, interests, revaluations, charges, for works and services provided at the cemeteries of Latina by a company, without the administration having renewed the contracts, issued commitment determinations, but not even warning that he would no longer perform the services; indeed, for certain positions, issuing verbal continuation orders. It is the complex matter that reached the Budget Committee of the Municipality of Latina yesterday, so complex that the commissioners, after a long discussion, preferred to postpone it for further investigation.
The story began in 2007, when the company began to carry out, with contracts and assignments, maintenance work, but also services such as the reception of citizens, the movement of bodies, and also the reception of bodies received by the judicial police in the event of death on the municipal territory with the bodies not claimed by anyone. Works and services carried out at both municipal cemetery structures, the urban one and that of Borgo Montello. With regards to the latter, the reported non-payment is just over 8 thousand euros, for 4 unpaid invoices from 2010. The broader problem is related to the urban cemetery, for which in 2009 the Municipality approved the finance project with the related agreement for the expansion and management of the urban cemetery by Ipogeo. The contracts are not renewed and the commitment decisions are not issued, but the company continues to work continuously, by virtue of the previous contracts, complete with an office in the cemetery, also due – according to testimonies – to verbal assignments by then managers of the Municipality (one in particular, who has since passed away), especially relating to the management of the autopsy room. Until 2014, when the Municipality blocked everything. The company then sends the invoices, which are promptly contested by the administration.
For the urban cemetery, the request is heart-shaking: 387,420 euros of services plus 177,510 euros of maintenance. The company sues the Municipality, and we get to 2023, when the judge, also in the face of testimonies from the workers, and documentary evidence such as the judicial police reports of the delivery of the bodies to the employees, establishes the company’s reasons, also issuing a settlement order between the parties. Transaction that starts from 573 thousand euros, to which legal costs, interests, revaluations and other charges should then be added: the company requests 400 thousand euros, the Municipality offers 89 thousand, finally closing at 200 thousand. It must be paid by June 30, as the offices insisted yesterday, but the city councilors want to see clearly the matter, especially because a transaction (which must be voted on by the councilors) is an act that could always be at risk of verification by the Court of accounts. So here is the postponement, probably until Friday morning.
