Sassari, reported for violence: unexpected turning point in the trial

April 28, 2024

The 40-year-old and the turning point in the trial at the Sassari court.

A 40 years old of Sassari was accused by his ex of abuse in the family and also of sexual violence. She made serious accusations, which the woman would have tried to support in court before the Sassari judges. After the separation, according to the woman’s story, there had been some serious episodes, so much so that she was forced to report her 40-year-old.

But during the hearing, a procedural turning point occurred that perhaps not even the forty-year-old had hoped for. First of all, the crime of domestic abuse was declassified in beatings. But, due to the Cartabia reform, the woman should have filed a specific complaint, which the offended party did not file. For this reason the man was acquitted of the charge of battery.

As regards the second charge, sexual violence, after the woman’s story, the judges, considering the circumstances of the facts, decided to acquit the man. All charges against the man were therefore dropped, who perhaps, at the beginning of the proceedings, would not have hoped for such favorable circumstances.
