Regional councilors who change political groups during the legislature lose their positions, if any, as members of the presidency of the Assizes, president and vice-president of the Commissions.
It is the regulatory provision that aims to introduce the 5-star exponent of Palazzo D’Aimmo Roberto Gravina with the proposed law to amend the Statute presented in these hours. An anti-transformation rule that is inspired by what happens in the Senate. Specifically, the bill provides that councilors who become part of a council group other than the one to which they belonged at the time of election will lose their office as president of the Assembly in via IV Novembre and as president and deputy of the Commission, where the change has not been approved by the group of origin or does not occur following the dissolution or merger of one’s group with others.
In the Senate this model was introduced with the changes to the Palazzo Madama regulations in 2007 which were strengthened in 2022. The rationale that supports the sanction lies in considering the “group-centric” approach of the Italian Parliament, for which the senator is elected for a specific position by virtue of his membership of a specific group and not as an individual parliamentarian.
Similarly to what happens in Parliament – explains Gravina in the report to the deposited text -, also in the Molise Regional Council, at the time of the elections to the offices of the presidency and the council commissions, the regional councilors are elected by virtue of their membership to a specific group and not as individual councillors. The proposal – Gravina finally summarizes – must be understood as a common sense modification against political transformationism”.
The proposed law will now be assigned by the President of the Regional Council Quintino Pallante to the Permanent Commission dealing with the matter, which after the investigation and the expression of the opinion of competence will send it to the Chamber for the final decisions.
