The Civil Court of Turin accepts the appeal presented by various consumer associations. For Judge Ratti: “The communication campaign deceived consumers”
Sting for the confectionery company Balocco and for the influencer Chiara Ferragni after the Civil Court of Turin accepted the appeal presented by various consumer associations, Codacons, Adsbef and Users of radio and television services. The sentence issued by the first section of the Turin Court recognizes in the action of the Bolocco industry, which is based in Fossano, province of Cuneo, a “unfair commercial practice” in violation of the Consumer Code, regarding the charity campaign linked to the Christmas pandoro, with part of the proceeds going to the Regina Margherita children’s hospital in Turin.
Balocco’s reaction
After the ruling of Civil Court of Turinthe Piedmontese confectionery company responds by underlining that the decree “he limited himself to repeating the content of the decision of the Competition and Market Authority. While it rejected the request of some consumer associations (Codacons, Adusbef and Assourt) to pay one million and 500,000 euros as compensation for damage as part of the ‘Pandoro Pink Christmas’ operation.
On the other side of the barricade, the consumer associations which, however, following the sentence issued by the Civil Court of Turin, declare that the decision: “opens the door to compensation for consumers of the special Christmas pandoro deceived by the messages launched by the company” and adds, “it worsens the influencer’s position in the investigation for aggravated fraud opened by the Milan prosecutor’s office”.
The sentence
According to a passage of judgment, as reported by the news agency HANDLE: “the commercial practice, in addition to being contrary to professional diligence, was at least capable of distorting to an appreciable extent the economic behavior, in relation to the product, of the average consumer”.
For consumer associations, the cause of the injunction on the Balocco-Ferragni case, the “the sentence is sensational”. According to the judge Gabriella Ratti of the Civil Court of Turin and as reported by ANSA, the messages of the communication campaign “they were found to be suitable for providing an incorrect representation of the charitable initiative (…) suggesting, contrary to the truth. that by purchasing the ‘Pandoro Pink Christmas’ the consumer could contribute to the initiative to finance a new machine for the therapeutic treatment of children suffering from osteosarcoma and Ewing’s sarcoma being treated at the Regina Margherita hospital in Turin”.

The Milanese magistrates
