LIVORNO. «I’m innocent, I didn’t kill Denny. Before he died he hugged me and said: “You are my friend, number one”. I don’t understand why people consider me a murderer, but it’s not like that: immediately after the tragedy, my wife, I and my two children went to Tunisia, but then we returned to Livorno. If I were the culprit, do you really think I would have returned to Italy? No. I came back to tell the police everything, because I had nothing to do with the murder. I trust in justice, but I am afraid that the people who beat me after I signed in the barracks will find me again. I don’t know them, I don’t know who did it.”

Hamed Hamza – the thirty-three-year-old Tunisian investigated together with his friend Amine Ben Nossra for manslaughter for the death of the twenty-nine year old from Livorno Denny Magina – speaks for the first time after the arrest ordered by the court, a precautionary measure no longer in force for almost a month. He does it while he is, still in preventive custody, at home with the obligation to live in the city and the ban on leaving the house from 10pm to 7am due to the risk of escape. The young man, also under investigation for the alleged cocaine dealing from the apartment he occupied illegally, returns to reiterate his innocence after the Spire drama. It was the night between 21 and 22 August 2022 when Magina, who had now become the “child” of all the people of Livorno, fell from a window on the fourth floor of the public housing in via Giordano Bruno. According to the public prosecutor in charge of the investigation, Giuseppe Rizzo, he was punched by Hamza, nicknamed “The Boxer”, and then lost his balance and fell from the building. Dying in hospital after emergency transport with an SVS ambulance in via San Giovanni. “Science fiction”, this is how the thirty-three-year-old dismisses the accusatory hypotheses.

«When Denny fell, I wasn’t in that room – continues Hamza – I was there together with the other two boys (Ben Nossra, currently with an obligation to live in Udine, and the thirty-year-old Niko Casoli from Livorno, in prison but for other crimes ed). Niko was the last to see him, then he joined us. The mark of the ring I wore on his wound? I repeat: it’s science fiction. I am absolutely not responsible for Denny’s death, he who unfortunately passed away knows this. I’m afraid of the judgment of the people of Livorno, I know they don’t believe me and it’s a problem because I live here with my wife and my children who were born in this city and want to grow up here.”

Comrade Rima also speaks, who in turn breaks the silence on the Spire tragedy. «Hamza and Denny were very good friends – her words – and he was a golden child. He knows what happened, but unfortunately he will never be able to tell the truth because he is no longer with us. How did he die? He fell, Hamza had nothing to do with it. When he fell I was sleeping, then I woke up and went down. I waited for the ambulance to arrive and left.”

According to the police, who entered the occupied apartment after the tragedy without finding anyone, there was a general stampede after Denny’s death. Two witnesses, with their cell phones, filmed the moments following the drama, in which people can also be seen looking out from the condominium of the provincial institute for public housing. No one ever set foot in that accommodation again.

In the meantime, the investigation is continuing, with Hamza and Ben Nossra who are accused of drug dealing and under investigation, given that the crime line is further back than the alleged cocaine sales, for manslaughter. Both are prohibited from leaving the house at night and are required to stay in the cities where they live, Livorno and Udine respectively. The public prosecutor, for them, has closed the investigation on the hypothesis of the crime and will shortly ask for the indictment, while for Casoli the dismissal has been requested due to lack of sufficient evidence to support a trial (he is in prison in Prato, but for other crimes ed). «We will remain here until the end – concludes Rima, Hamza’s partner – we trust in justice and we will wait for the court’s decision. We didn’t run away immediately after the tragedy, in fact we returned to Livorno after being in Tunisia for a period, so we remain confident that we will get to the truth.”
