TURIN – The Court of Cassation he decided to annul the conviction for theFrasheri murderwhich took place in Turin on October 22, 2017. Initially, the Court of Appeal of Turin had sentenced three suspects – Brakay Sabri, Banuschi Cerciz and Muratay Hasim – to 23 years of imprisonment for causing the death of Frasheri Shpetim with a gunshot to the abdomen.
The murder
Camera footage had documented the murderous action, and precautionary custody orders had been issued against the defendants, which had not been carried out due to their absconding.
The fatal attack appeared to have been a reaction to an attack suffered by the victim, who had attacked another man, Rushiti Donald, known as Doni. The latter had confessed to the crime and was sentenced to 10 years and 4 months in prison.
The decision of the Supreme Court
Today, the Court of Cassation surprised everyone by completely annulling the three convictions, and ordered a new trial before a different section of the Turin Court of Appeal. The decision was made following the arguments put forward by the defence, composed of the cassation expert Dario Vannetiello and the lawyers Marcello Severino, Ilenia Mehilli, Cosimo Palumbo and Enrico Calabrese.
The motivation for this unexpected decision is still unknown, but it seems that specific legal questions have influenced the Court of Cassation, despite the overwhelming evidence provided by the cameras and Rushiti’s confession. The hope is that the new trial can provide further clarification on this complex legal matter.
