MALVASO WAIVES THE PRESCRIPTION. THE TRIAL IN THE COURT OF APPEAL

The trial of the two political exponents of Latina, Vincenzo Malvaso and Giuseppe Di Rubbo, both involved in the maxi trial called “Olimpia” which led to the arrests of politicians, administrators and entrepreneurs of the capital in November 2016, has reached the Court of Appeal. As is known, the trial practically resulted in judicial death as many crimes are time-barred; for Malvaso, however, there was an acquittal, subsequently confirmed also by the Court of Appeal.

From one branch of that maxi investigation also arose, against Malvaso and Di Rubbo, the trial for abuse of office and violation of urban planning regulations regarding the construction of the building in Via Piave in Latina, seized again on March 30th. The current provincial coordinator of Forza Italia Giuseppe Di Rubbo and the former municipal councilor, once president of the urban planning commission of the Municipality of Latina, as well as building contractor, Vincenzo Malvaso, were convicted in July 2017 by the then judge for the preliminary hearing of the Court of Latina, Pierpaolo Bortone.

Years after the facts, the crimes are time-barred, even if the sentence, as established today, 19 April, will be issued on 16 September after the discussion by the defense lawyers Renato Archidiacono and Giuseppe Poscia. Malvaso, in any case, has already announced that he has renounced the prescription.

The affair of the so-called Malvaso palace has returned to the attention of public opinion not only due to the recent seizure, but also due to the dialogue between the former Forzista exponent himself and the Celentano administration. Malvaso, in fact, obtained from the TAR the annulment of the demolition order of the building in Via Piave and, in exchange for the Municipality’s failure to appeal to the Council of State, it gave up asking for damages from the Piazza del Popolo institution. A quid pro quo that has caused discussion, especially since Malvaso’s nephew, the current councilor for Productive Activities, Antonio Cosentino, sits on the Celentano Council.
