Parental leave 2024, INPS clarifications on how it works — idealista/news

The latest 2024 budget law introduced important innovations regarding the “Consolidated text of legislative provisions regarding the protection and support of maternity and paternity”. In detail, the allowance has been increased from 30% to 60% of the salary parental leave (which for the current year alone will be 80%). But who can benefit from it and how is it requested? What is parental leave

The parental leave it is a period of optional abstention from work, granted to male and female workers, to take care of their child in his first years of life “and satisfy his emotional and relational needs”, we read on the website of the Department for Family Policies. During this period, employees perceive areplacement financial allowance of income from work.

Specifically, you can request an additional monthly payment to be used within the sixth year of the child’s life, or within six years of the minor’s entry into the family in the case of adoption or foster care. For 2024 only, the increase in the parental leave allowance, for the additional month, is equal to 80% of the salary (instead of 60%).

Who is entitled to parental leave

They can request a month of parental leave, compensated at 80% of their salary:

  • Workers in the private sector;
  • Public sector workers.

Parental leave is available to self-employed parents provided that they have paid contributions for the month (or part of the month) preceding the one in which the leave begins and that during the leave period there is effective abstention from work.

The parental leave consists of 3 months for each child. The allowance can be received within the first year of the minor’s life (or from his entry into the family) and is expected to be 30% of the conventional daily salary expected on an annual basis by the laws of the working category. The possibility of taking leave starts:

  • for the mother, from the end of the compensable period of maternity leave;
  • for the father, from the birth of the minor (or from the minor’s entry into the family).

Parental leave, what’s new for 2024

There novelty introduced by Budget law 2024 it does not add, as INPS specifies, an additional month of compensated parental leave. Simply, it provides for the increase of the allowance to 60% of the salary (80% for the year 2024 only) for a further month (compared to that already provided for by law no. 197 of 29 December 2022, hereinafter the 2023 Budget Law) of three due to each parent and not transferable to the other.

The increase is recognized provided that the month of parental leave is enjoyed within 6 years of life (or within 6 years of entry into the family in the case of adoption or foster care and, in any case, no later than the age of majority) of the minor. The aforementioned legislation provides that, for the year 2024 only, an allowance of 80% of the salary is due instead of 60%.

The increase of the additional month to 60% of the salary (80% for the year 2024 only) of the allowance in question also applies to adoptive or foster/placement parents and affects all methods of using parental leave: full, split by months, by days or in hourly mode.

INPS also underlines that theadditional month compensated at 60% of salary (80% for the year 2024 only) is only one for both parents and can be used split between them or by only one of them. It should be noted that “alternating” use between parents does not preclude the possibility of using it on the same days and for the same child, as permitted for all periods of parental leave.

Consequently, within the maximum limits of both parents provided for by article 32 of Legislative Decree no. 151/2001 (10 months which can be increased to 11 months in the event that the father abstains for a whole or fractional period of not less than 3 months), to be enjoyed within 12 years of the child’s life or within 12 years of entry into the family of the minor in the case of adoption or foster care and, in any case, no later than the age of majority, the parental leave of both parents or of the so-called “lone parent” is compensable as follows:

  • one month is compensated at 80% of the salary, within 6 years of life or within 6 years of joining the family in the case of adoption or foster care of the minor;
  • a further month is compensated at 60% of the salary (80% for the year 2024 only), within 6 years of life or within 6 years of entry into the family in the case of adoption or foster care of the minor;
  • seven months are compensated at 30%, regardless of the income situation;
  • the remaining 2 months are not compensated, except in the case in which the applicant is in the income condition provided for by article 34, paragraph 3, of the TU
