Fortson, based at the Special Operations Wing of Hurlburt Field, was in his Fort Walton Beach apartment five miles from the military base, on a call with a woman, when he heard a knock on his door. According to the civil rights lawyer Ben Crump, consulting with the girl Fortson was on the phone with, the airman asked who he was without receiving any answer. After hearing more shots strong and having checked through the peephole without seeing anyone, the soldier went to retrieve his pistol duly detained, as cited by Crump. While he was returning to the living room the officers, who had set off after receiving a report for disorders at an area apartment complex, they did irruption in home. Once they noticed the gun, they killed him by shooting him six times.

There CBS wrote that Fortson died in hospital. The office of sheriff of Okaloosa County released a statement saying officers “reacted to legitimate defense after meeting the gunman” and asking the community to wait “to understand the facts that ensued.” Crump pointed out that the young man had joined the Air Force immediately after graduation and had no no type of precedent. Furthermore, he called for the immediate release of the video from the bodycam to resolve the matter and “admit that the men entered his home by mistake.” The officer from whose gun the fatal shots were fired was temporarily suspended suspended.
