The Court of Crotone sentenced Anna Perugino, the woman believed to be the instigator of the punitive expedition, to eight years in prison, but downgraded the crime from complicity to attempted murder to conspiracy to cause very serious injuries. According to the experts, it was not the punch that caused Davide Ferrerio’s brain damage but the impact on the asphalt.

The second sentence arrives for the attack on Davide Ferrerio but with a big innovation: the reclassification of the crime from complicity to attempted murder and very serious injuries. This is in fact the decision of the Court of Crotone today Anna Perugino sentenced to eight years in prison, the woman believed to be the instigator of the punitive expedition and mother of the little girl involved in the brutal beating. A lower sentence than that requested by the prosecutor as the defense’s request for requalification of the crime that was committed was accepted downgraded to anomalous participation in very serious injuries.

In the same proceeding, however, the partner of the woman who on the evening of August 11, 2022 was part of the punitive group that wanted to confront a man who was annoying Perugino’s daughter on social media was acquitted. Davide Ferrerio, who was passing by chance in that area, was mistaken for the target of the raid and was attacked by Nicolò Passalacqua, the man already sentenced in first instance to 20 years and 4 months with an abbreviated sentence as the material perpetrator of the beating. The young man from Bologna has since been hospitalized in an irreversible coma.

The new sentence could now also have repercussions in the appeal process for Nicolò Passalacqua which is underway in Catanzaro. In fact, the man was convicted of attempted murder for punching the 21-year-old now in a coma but today’s sentence declassified the crime. Fundamental to this decision the advice of the Court expert. The criminal panel had in fact appointed an expert to resolve a key point in the proceedings: whether Davide Ferrerio’s condition was due to the punch or the fall on the asphalt.

Davide Ferrerio reduced to a coma due to mistaken identity, prosecutor: “A commando acted, they must all be condemned”

According to the expert, it was not the punch thrown by Passalacqua to cause Davide Ferrerio’s brain damage but the impact on the asphalt. Hence, as also supported by the woman’s defender, the reclassification of the crime. The Court also rejected the Municipality of Bologna’s request for compensation for damages and recognized that for the other civil parties separately. Perugini was sentenced to pay a provisional amount of 500 thousand euros for Davide Ferrerio, 150 thousand euros for the boy’s family and 10 thousand euros for the Municipality and Province of Crotone.
