CASERTA – The president of the Tar Campania Alessandro Tomassetti ha suspended the effectiveness of the determination of the manager of the environment sector of the Municipality of Caserta Luigi Vitelli, issued on 28 June last, which provided for the handover of the sector garbage collection between the outgoing manager Isvec And the society Si.Ecowhich has been awarded the new municipal environmental hygiene contract lasting one year. A trust which Isvec had already challenged in recent weeks at the Campania Regional Administrative Court, which however, instead of suspending it as a precautionary measure, had set a hearing on the merits for next October 24, therefore within a rather short time frame, absorbing the precautionary phase on the assumption that Isvec’s demands were based on well-founded reasons and would not be harmed during the hearing on the merits.
The municipality had gone ahead despite the decision
Despite the TAR’s decision, the Municipality still went ahead with the assignment to Si.Eco, although it was convenient for them to wait to avoid having to pay, in the event of Isvec’s victory, a substantial compensation; and so on June 28th Vitelli appointed the sole person responsible for the procedure, identified in the employee of the Municipality’s technical office Raffaele De Rosa, and on the 29th the latter issued a provision in which he asked Si.Eco to complete the transfer of the construction site by July 15th and Isvec to send the necessary documentation to guarantee such transfer.
The appeal
Against these measures, Isvec presented an immediate precautionary appeal for additional reasons through the lawyer Renato Labriola, which the president accepted, setting the date of July 25 for the hearing in which the panel will hear the parties and confirm or not the suspension.
