CASERTA – The new legislation called “red code” had recently come into force, when the trader was arrested in November 2019, sent back to prison for a few days and then benefited from house arrest, on charges of having threatened to kill and repeatedly beaten the wife with serious injuries also found by multiple medical certifications and in the presence of minor children. He has always declared himself innocent and therefore innocent of the accusations. The trial against him promised to be difficult and the defendant’s sentence seemed certain. The Court of Santa Maria Capua Vetere, in collegial composition, given the seriousness of the accusations, heard about ten witnesses who initially confirmed the accusatory system put in place by the Public Prosecutor’s Office. The turning point came when the witnesses were questioned during the hearing by the lawyer Ugo Cepparulo di Casagiove, defender of Giuseppe Solla, accused. The lawyer managed to highlight a series of contradictions and uncertainties which, after years and numerous hearings, pushed the Court to acquit the accused for not having committed the crime. From the hearing, in fact, it emerged that the accusations were either exaggerated or devoid of objective corroboration, as even the medical certifications, initially apparently linked to the beatings suffered by his wife, in reality had a different genesis. Solla also obtained success before at the Juvenile Court of Naples where, following the indictment, a case was initiated for the loss of parental rights over minor children. Also in this case, after hearings and interviews, appointment of experts and report from social services, the defensive line adopted by the lawyer Cepparulo convinced the judges of Solla’s innocence and at the end of the trial they did not adopt any disqualification measures.
