the legal battle moves to the Council of State

VOGHERA (PV) – The conflict over the project for a biogas plant in Campoferro shows no signs of abating. There Province of Pavia appealed to the Council of State the ruling of the Lombardy Regional Administrative Court which had annulled the authorization granted to the company Voghera Green Energy. The Municipality of Voghera, a firm opponent of the project, has appointed a lawyer to follow this new piece of litigation.

A push and pull between the Municipality and the Province

It seemed that the Municipality had prevailed when, at the end of 2023, the TAR upheld its appeal against the authorization issued by the Province. It was the second victory for Voghera, after the cancellation of the previous authorization in 2022. The TAR had considered the Municipality’s concerns for the health of citizens and the environmental impact of the plant to be valid.

But the Province did not give up and decided to bring the issue to the Council of State. He believes the City’s concerns are unfounded and that the plant does not pose a threat to health or the environment. He therefore trusts that the Council of State will agree with them and unblock the project.

Regardless of the outcome of the appeal, the problems related to the plant remain open. The “olfactory discomfort” and the impact on traffic are the main concerns of the Municipality and citizens, especially considering the presence of a community of people with mental disabilities nearby. The Province will have to find a way to resolve these critical issues if it wants to move forward with the project. The future of the biogas plant in Campoferro is uncertain and the decision of the Council of State will be fundamental.

Attention remains high on the part of all the actors involved, citizens, associations and institutions, who anxiously await the ruling of the Council of State, which could have a significant impact on the future of Campoferro and the surrounding area.
