Truck-camper crash on highway – A 69-year-old from Bagnoregio is accused

Viterbo – Ten-year-old boy died in the crash between a truck and a camper on the highway on 3 January 2018, the 69-year-old lorry driver from Bagnoregio EC was sentenced yesterday to 3 years and 8 months of first-degree imprisonment for murder and road injuries of the mother who, seriously injured, remained hospitalized for a long time at the Belcolle hospital.

Thus, the trial for the death of little Davide Ciuffreda ended before judge Ilaria Inghilleri. The prosecution had asked for 2 years and 3 months. The civil lawyer of the parents Michele Antonio and Antonella Incerti, in addition to the sentence, asked for compensation of 750 thousand euros for the mother and 600 thousand euros for the father – who will now have to be examined by the civil judge – with provisional payments of 100 thousand euros each.
The defense, which fought for acquittal – insisting among other things on the shortcomings of the preliminary investigations carried out by the prosecutor’s office, the failure of the investigating judge to accept the request for an evidentiary hearing and the “totally flawed technical consultancy” of the engineer Lucio Pinchera – recalled during the discussion how the family had already been compensated by the insurance, although they could take civil action against the accused following the conviction.
The tragedy occurred on the morning of January 3, 2018, at kilometer 60,100 of the highway, between Vetralla and Viterbo, following the collision of the camper in which the family was traveling who was returning to Albinea, in Emilia Romagna, after spending the Christmas holidays in Tuscia.
At the time of the crash, little Davide was sitting with his mother inside the vehicle pulled over on the side of the highway, on a stretch without an emergency lane, following a breakdown that his father was trying to resolve. The truck, coming from behind, hit the camper, devastating it and killing the child for whom, despite the timely help, there was nothing that could be done.

In the Italian criminal system the presumption of innocence applies until the final sentence. Presumption of innocence which is based on article 27 of the Italian constitution according to which a person “is not considered guilty until finally convicted”.
