NOW is sending an email to all subscribers announcing the variation in the price of the offers which the video streaming platform had promoted with the words “forever“. This change is part of the more general adjustment of the contractual conditions which from 2 May brought the cost of the Sport Pass from 14.99 euros/month to 24.99 euros/month in the case of monthly payment and from 9.99 euros/month at 14.99 euros/month in the case of a 12-month commitment.
It was precisely this that raised perplexity among NOW customers, that is, the fact that the unilateral contractual modification had regarding offers labeled “forever”, previously subscribed under certain economic conditions. There are various testimonials relating to the offer online Sports, Cinema, Entertainment and Kids which could be activated until May 2021 at 19.99 euros per month, forever, and which starting from July will go to 29.99 euros/month.
There are those who have cried foul, but despite everything it is there same description as the offer to justify the regularity of NOW’s decision.
First of all, it is specified that the monthly price remains unchanged “except for any changes in the amounts due to increases in the VAT rate” (but this is not the case). Then we read: “Viewing is conditional on acceptance and compliance with the general conditions of the NOW Service“. In point 8 of the conditions, valid from 28 September 2023, it is written:
Sky will be able to update prices periodically and vary these General Conditions upon notice to the Customer […] in the presence of justified reasons such as: legislative, regulatory changes, organisational, administrative, technical needs, variation of the contents offered, modification or modernization of the technical solutions for providing services […].
In summary, the unilateral modification to the contract made by NOW is provided for by the general conditions, even in the case of “forever” offers. Just one piece of advice: before signing a contract – any contract – it is always a good idea to read all the clauses, even at the risk of seeming fussy.
