Death of Lavinia Marano, no culprit: the four doctors acquitted

MESSINA. No one guilty for the death immediately after giving birth of the singer from Messina Lavinia Marano: in fact, the four doctors who had been convicted at first instance, namely the head of the Gynecology and Obstetrics department, were acquitted at the Court of Appeal Onofrio Triolo and the doctors on duty that evening in 2016, Antonio Denaro, Vittorio Palmara and Roberta Granese. In November 2023 the Court of Appeal had issued an order to carry out further investigations into the responsibilities of the doctors and today the sentence was issued which acquitted the doctors of the crime attributed to them “because the fact is not foreseen by law as a crime” . In December 2022 there was the verdict of the single judge of first instance, Rita SergiThat sentenced four doctors to one year’s imprisonment (with suspended sentences) and acquitted six of them (here is the link to the article with the whole story and the charges).

The 44-year-old had been admitted to the Polyclinic to give birth. On September 22nd she gave birth to her son by cesarean section, the baby was born in perfect condition. Then the need arose to intervene to stop the bleeding. The doctors had to remove the uterus. Unfortunately, the woman’s condition worsened until the following morning, when she passed away. The prosecutor’s office had opened an investigation into the case which resulted in the request of indictment for manslaughter against ten “white coats” by the deputy prosecutor Rosanna Casabonaaccepted in November 2018 by the investigating judge Tiziana Leanza. The trial began in June 2019 and in November 2022, at the end of the indictment, the deputy prosecutor Anna Maria Arena he had requested a two-year prison sentence for nine doctors and acquittal for one “for not having committed the crime”.
