With sentence no. 248/2024 issued on 04.15.2024 by the Court of Civil Appeal of Perugia, to define the referral judgment RG 520/2021 introduced by the Commissioners of the 2008 judiciary competition, all magistrates or university professors and, in particular, by the professors. re Cangelli Francesca and Cordopatri Francesco, as well as data by doctors Fumo Maurizio, Ielasi Domenico, Perrotti Massimo and Sigillo Carmelo against doctors Fabrizio Gatti and Bruno Manfellotto following referral from the Court of Cassation, against the sentence of the Criminal Court of Perugia n.1822/15, deemed defamatory a passage contained in the article “Not suitable, or rather yes, or rather no” published in L’Espresso on 9.09.2010 and a further passage contained in the article “That Commissioner is a rocket” published in L’Espresso on 9.9.2010 and consequently condemned Dr. Gatti author of the aforementioned articles together with Dr. Manfellotto as director responsible for the newspaper at the time of the facts (i) to compensation for the damage suffered by the aforementioned Commissioners, liquidated on an equitable basis by the Court of Appeal in the amount of 8 thousand euros for each, plus interest and revaluation from the date of publication of the articles (ii) to the publication of the sentence and (iii) to the full reimbursement of the litigation costs of the cassation proceedings and the referral proceedings.
