The ruling of the Court of Cassation which at the end of April canceled the fine for speeding received by a motorist on the Treviso ring road is also having its first effects in Friuli Venezia Giulia. Specifically in Pordenone, where the local police adopts a more prudent and factual line than ever “turns off” all speed detectors to avoid a tsunami of appeals.

The opposite policy, however, is that of Fvg Roadsthe managing body of the main regional road network: in that case the veloxes remain on.

WHAT HAPPEN

Last April 22, the Supreme Court of Cassation ruled in favor of a lawyer from the Treviso Bar, who resisted in the third degree of judgment against the Municipality of Marca. The triggering reason? A fine for speeding taken by his client, who it proceeded at 97 kilometers per hour out of the 90 that represented the limit.
The issue, perhaps a trivial but important one, concerns the non-homologation of devices for the electronic control of vehicle speed on the roads. Velox approved, according to the Court, but not approved. So fines to be canceled and Municipalities with trembling wrists. And it is precisely for this reason that in recent days the most important local police in Western Friuli, as well as one of the largest in the entire region (that of Pordenone and Cordenons) has effectively “frozen” all its control devices.
«At least until clarity is clarified on the concrete interpretation of the sentence – explained commander Maurizio Zorzetto – thethis was the decision». The objective is only one: not to have a sea of ​​appeals similar to the one that has effectively put the system of electronic fines throughout Italy in crisis on the desk of the mayor Alessandro Ciriani and more generally of the Municipality of Pordenone.

THE CONSEQUENCES

In Pordenone and Cordenons, i.e. in the territory in which the jurisdiction of the local police of the capital of the Right Tagliamento extends, no more electronic speed control. Neither fixed nor mobile. The Command is equipped with both telelasers and actual speed cameras, but it was decided to reduce any margin of risk to a minimum and to dedicate ourselves for the moment to other activities. «For example, operations with the Targasystem device – explained the commander of the Pordenone traffic police, Maurizio Zorzetto – which allow the calculation of the date of the inspection and compliance with the vehicle insurance obligation». And again the wild stop. In short, there is certainly no shortage of work, but if the Municipality had put on the agenda the doubling of the proceeds deriving from fines on the roads, perhaps we will at least have to wait.

DIFFERENT POLICIES

And what do the other bodies do? The Municipality of Pordenone has chosen the line of maximum prudence. However, there are other subjects who rely on a particular nuance of the ruling of the Court of Cassation, which would include only certain types in the list of non-approved speed control devices. «The network covered by Fvg Strade – explained for example the regional councilor for Infrastructure, Cristina Amirante – at the moment it keeps all the speed control devices working, given the type of technology behind them».
For example, we talk about the camera that immortalizes the cars on the Pontebbana in Codroipo, similar to the “twin” one of the Napoleonica in Castions di Strada and the one on the Ferrata near Madrisio. The same goes for the detectors on the Valcellina road. But above all for the new velox on the Cimpello-Sequals.
“The problem does not arise for us – they explained instead from the Municipality of Udine – since we do not use fixed devices on the roads”.
